Terms and Conditions for Eiron.ai iOS App

1. Acceptance of Terms By downloading, accessing, or using the Eiron.ai iOS mobile application ("App"), a product of Fluxion Tech Limited, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App. These Terms are governed by and construed in accordance with the laws of the United States of America.

2. Age Requirement The App is intended for users aged 18 and above. By using the App, you represent and warrant that you are at least 18 years old. Our age gating mechanism is through confirmation that you are 18 or above during the sign-up process.

3. Our Services

3.1. Description of Services

The Eiron.ai iOS App is an interactive platform that allows users to engage with AI-driven characters through chat conversations and character creation. The App features a unique character creation template designed to capture the essence of story flow and adjust the behaviour of ai characters dynamically based on user inputs, enabling users to create personalized AI characters optimized for engaging chats. The App includes a swipe left and right feature to navigate through AI characters and their conversations, enhancing the user experience and encouraging exploration.

3.2. Modification of the Service

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

3.3. App Features and Limitations

The current version of the Eiron.ai iOS App focuses solely on text-based interactions, without images or voice. By concentrating on text, we aim to gauge user enjoyment of AI-based characters that excel in chatting abilities. We plan to introduce images and voices in future releases, enhancing the overall user experience.

3.4. In-App Purchases

The App does not currently include any in-app purchases.

3.5. Proprietary Language Model

The Eiron.ai iOS App uses our proprietary language model as the basis for generating text responses for the AI characters. This language model is trained on carefully curated data to ensure engaging and appropriate conversations. We do not use any third-party language models or APIs for text generation.

4. User Conduct When using the App, you agree not to:

• Create or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Use the App for any illegal or unauthorized purpose.
• Interfere with or disrupt the App or servers or networks connected to the App.

4.1. Reporting Inappropriate Content

To help maintain a safe and positive environment, we have implemented a reporting feature within the chat interface. By holding and pressing on a character's message, you will see a report prompt that will lead you to a pop-up page where you can report inappropriate content or behavior. Upon reporting a character, it will be removed from your view and will not be shown to you again within 48 hours. This reporting feature ensures that the App has robust content moderation available to prevent the display of objectionable or inappropriate user-generated content.

You agree to use the App's features, such as swiping left and the reporting feature, in accordance with their intended purposes and these Terms and Conditions.

5. Intellectual Property Rights

The App and its original content, features, and functionality are owned by Fluxion Tech Limited and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the App without our prior written consent.

All content within the Eiron.ai iOS app, including characters, storylines, plots, designs, and code, is the original work of our in-house team of designers and engineers. We brainstorm, research, and synthesize our content to ensure that the App does not infringe upon any third-party intellectual property rights, including trademarks, copyrights, or patents. In the event of any accidental infringement, please reach out to us immediately at contact@eiron.ai, and we will promptly investigate and take appropriate action to resolve the issue.

6. User-Generated Content

6.1. Creation of AI Characters The App allows you to create AI characters using the "Create Character" feature. By creating AI characters, you acknowledge and agree that you are solely responsible for the content you generate, including the character's name, greeting message, and selected plots. You can customize your AI characters using the provided options and interact with them by swiping left to navigate through the characters.

6.2. License Grant By creating AI characters, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user-generated content in connection with the App and our business.

6.3. Objectionable Content We have implemented measures to filter objectionable material and provide a process for users to flag offensive content. If you encounter any inappropriate or offensive user-generated content, please use the reporting feature within the chat interface to notify us. We will promptly review and take appropriate action upon receiving a report.

6.4. User Responsibility When creating AI characters, you are responsible for ensuring that your content does not infringe upon any third-party intellectual property rights, including trademarks, copyrights, or patents.

7. Third-Party Services The App uses Apple Sign-in for user authentication but does not use any other third-party services, websites, or applications. All content and functionality are provided directly by Fluxion Tech Limited.

8. Disclaimer of Warranties The App is provided on an "as is" and "as available" basis. Fluxion Tech Limited makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included in the App.

9. Limitation of Liability In no event shall Fluxion Tech Limited, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use or inability to use the App, to the extent permitted by United States law.

10. Indemnification You agree to indemnify, defend, and hold harmless Fluxion Tech Limited, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising from or relating to your use of the App or your violation of these Terms.

11. Termination and Account Deletion

11.1. Termination by Us We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

11.2. Account Deletion by You You can choose to delete your account if you no longer wish to use the App. We have implemented features to allow you to easily delete your account and associated data. Upon account deletion, we promise to remove all user data associated with your account. A confirmation screen is provided to ensure you intend to proceed with account deletion.

11.3. Data Export Currently, the App does not have a built-in data export option. However, if you wish to obtain a copy of your data before deleting your account, you can email us at contact@eiron.ai with your request. We will respond to your email by providing you with your data. Once you have received your data, you can proceed with deleting your account.

12. Changes to Terms and Conditions We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

13. Dispute Resolution In the event of any dispute arising out of or in connection with these Terms, or any non-compliance with our Terms and Conditions, we will uphold the law and pursue appropriate legal avenues to protect our users and our company. This may include arbitration, mediation, or the governing law and jurisdiction for legal disputes. By using the App, you agree to cooperate fully in any investigation or legal proceedings related to your use of the App or any violation of these Terms.
